The liability of MBD Studios for any errors, omissions, or failure to provide services for any reason shall be limited to the total amount paid by the Client. MBD Studios is not liable for indirect, consequential, or emotional distress damages. Client assumes complete liability for all claims of personal injury or property damage and agrees to indemnify, defend, and hold MBD Studios harmless in all such cases. Client is fully responsible for loss or damage (including weather) to equipment while on property owned or controlled by Client, excluding damage caused by an MBD Studios agent. Before posting any negative public feedback, Client is contractually required to notify MBD Studios in writing and participate in a 30-day period to resolve any disputes in good faith as an exclusive preliminary remedy. Failure to comply with this resolution process shall be considered a material breach of this agreement. MBD Studios retains ownership of all digital files and media created by MBD Studios during the event and may use such reproductions for marketing and commercial purposes. If Photography services are contracted, MBD Studios shall be the exclusive professional photographer. In such cases, MBD Studios does not guarantee specific images and maintains full artistic license. MBD Studios reserves the right to stop service without refund if a guest becomes hostile or if safety is threatened; in such cases, full payment remains due. Client agrees to fully complete and submit all required online planning forms provided in the client portal at least fourteen (14) calendar days prior to the event date. Completion of these forms is a condition precedent to MBD Studios' obligation to perform. Failure to submit completed forms by this deadline constitutes a material breach, and MBD Studios reserves the right to withhold performance without refund of any payments made. Client shall provide a 5 ft. table and a dedicated, grounded 15-amp electrical outlet. Late payments are subject to a $150 fee.

To qualify for this refund, a total cancellation means the entire event is officially called off and will not take place on the original date, or any other date, with any vendor. To process the refund, we require written proof that the event has been canceled. For commercial venues, this is a venue release notice. For private residence events, this requires copies of the termination notices from at least two other hired professional event vendors for that same date. This protection plan does not apply to voluntary service terminations, date changes, or location changes. If the event is rescheduled or relocated, the deposit remains strictly non-refundable and may only be transferred to a new date or location at the Company's sole discretion and availability.
